1. Agreement to these terms
These Terms of Use are an agreement between you and Massif Mortgage Co LLC dba Massif Capital Group ("Massif Capital Group," "we," "us"), 501 S Austin Ave, Fl 2, Ofc 313, Georgetown, TX 78626.
They apply when you use massifcapitalgroup.com, submit one of our forms, use our calculators, sign in to our client portal, or receive texts from us. By doing any of those, you agree to these terms and to our Privacy Policy. If you do not agree, do not use them.
If you use our services for a company, you confirm you are authorized to bind that company, and "you" includes it.

2. What we do and don't do
- We are a broker, not a lender. We help you prepare a financing request and present it to lenders and other capital sources. We do not make loans, decide whether you are approved, or set a lender's terms.
- Business purpose only. Our services are for financing used for business, commercial or investment purposes. You confirm that any financing you request through us is not for personal, family or household purposes.
- No commitment. Nothing on our website, in our calculators, or in a quote summary we send you is an offer or commitment to lend. Rates, terms and approval depend entirely on the lender's underwriting and can change until closing.
- No advice. We do not give legal, tax, accounting or investment advice. Talk to your own advisers before you commit to financing.
- Fees. Our compensation for a specific transaction is set out in a separate written agreement you sign with us. If that agreement conflicts with these terms, that agreement controls for that transaction.
3. Your information and documents
- Accurate and complete. Everything you give us must be true, complete and current. Tell us promptly if anything changes. Lenders rely on what you provide, and false information can end a transaction and may be a crime.
- Authorized. You confirm you have the right to give us every document and every piece of information you send, including information about co-owners, guarantors, tenants and other people.
- Sharing with lenders. You authorize us to share your information and documents with lenders and capital sources we consider suitable, and with the service providers described in our Privacy Policy, so we can pursue your request.
- Verification. We and the lenders may check what you provide, including by contacting third parties you identify. We may decline or stop work on any request, at any time, if we believe information is inaccurate or a transaction is unlawful.
4. Using the website, calculators and client portal
Calculators. Our calculators give estimates for illustration only. Results depend on what you enter and on assumptions that may not match any lender's terms.
Client portal. We give portal access by invitation only to people involved in a financing request.
- Keep your sign-in private and do not let anyone else use it. Tell us right away if you think someone has.
- Upload only documents related to your request, free of viruses or malicious code.
- Do not try to see files that are not yours, test or get around our security, copy or scrape the site, or use automated tools against it.
We may suspend or end portal access at any time, including when a request closes or if these terms are broken.
Our content. The website, calculators, portal and their content belong to us or our licensors. You may use them only to explore and pursue financing with us. Links to other sites are provided for convenience; we are not responsible for them.
5. Text messages
When you check the text consent box on one of our forms, or text us first, you agree that Massif Capital Group may send text messages to the mobile number you gave us about your financing request, including document requests, status updates, appointment reminders and replies. Marketing texts are sent only if you separately agree to them. Consent is not a condition of working with us.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to stop at any time. Reply HELP for help, or contact [email protected] or 512-517-9822.
- We may send texts using automated technology.
- Tell us if you change or give up the number, so texts do not reach someone else.
- Carriers are not liable for delayed or undelivered messages.
Our Privacy Policy explains how we handle your number. We never share mobile numbers or text consent with anyone for their marketing.
6. Disclaimers
Our website, calculators and portal are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that financing will be available, that any lender will approve you, or that the services will be uninterrupted or error-free.
7. Limits on our liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunities or the cost of financing, arising from these terms or your use of our services. Our total liability for all claims under these terms is limited to $100. Nothing here limits liability that the law does not allow to be limited, and nothing here changes a separate written agreement you sign with us for a specific transaction.
8. Your responsibility to us
You agree to defend and reimburse us for claims, losses and reasonable attorneys' fees caused by information you gave us that was false or that you were not authorized to share, or by your breach of these terms.
9. Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising from these terms or our services will be resolved only in the state or federal courts located in Texas, and you and we consent to those courts' jurisdiction. TO THE EXTENT THE LAW ALLOWS, YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL. Any claim must be brought within one year after it arises, unless the law requires a longer period.
10. General
We may update these terms by posting a new version with a new effective date; the version in effect when you use our services applies. If any part of these terms is unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver. You may not transfer your rights under these terms; we may transfer ours to a successor. These terms and our Privacy Policy are the whole agreement about your use of the website, calculators, portal and texts.
